Load Limit – East West Road Bridge over Moe River, Darnum

Due to the high risk of further damage to East West Road Bridge over Moe River, Darnum from heavy vehicles, Baw Baw Shire Council imposed an interim 12tonne load limit on the bridge.

Baw Baw Shire Council (Council) hereby gives notice pursuant to sections 206(1), 223 and clause 12(2) of Schedule 11 of the Local Government Act 1989 (Act) to continue the interim 12 tonne load limit on East West Road Bridge over Moe River; Darnum.

This bridge is located between Nilma Bona Vista Road, Nilma and Gaul Avenue, Darnum.

Pursuant to section 223 of the Act, any person has a right to make a submission on the proposed road discontinuances.

Submissions must be received by Council by 5.00pm on Tuesday 20 February 2024 and should be addressed to the Chief Executive Officer, Baw Baw Shire Council, P.O. Box 304, Warragul, 3820.

If a person wishes to be heard in support of his or her submission they must include the request to be heard in the written submission and this will entitle them to appear in person or by a person acting on their behalf, before a meeting of Council.

All submissions will be considered in accordance with section 223 of the Act.

Submissions made in accordance with section 223 of the Act are not confidential and;

  • may be incorporated in full (including any personal information) into the agenda and minutes of any Council or Committee meeting at which the matter is considered; and
  • may be made available on Council’s website as part of any relevant Council or Committee agenda and minutes; and
  • must be made available for public inspection in accordance with the provisions of the Act.

Following consideration of submissions, if in the opinion of Council the use of a road by motor vehicles of, or over, a certain weight poses an immediate risk of danger to people or damage to property (including damage to the road itself),

 Council may still resolve to continue the interim load limit until such time the bridge can be replaced.
