An occupier of private land must not, or must not allow another person to, keep, store, place, repair or in any other manner use a shipping container on that land without a permit issued under this Local Law, unless permitted under the Planning Scheme or for which the Planning Scheme requires a planning permit. In cases where a planning or building permit has been obtained, a Local Law Permit is not required. Local Law permits can only be issued for the use of temporary storage. Shipping containers cannot be located over easements or flood overlays. Containers must not direct storm water or overland flow caused from rainwater onto adjoining properties.
Shipping containers must be located at least 1.0m from existing dwellings and boundary lines.
Standard shipping container sizes are 2.44m WIDE, 2.6m HIGH and 6.06m (20ft) or 12.2m (40ft) LONG.
Containers cannot exceed a maximum height of 3.0m.
Containers must be neutral colour tone (cream and ivory, beige, tan, khaki, grey and taupe).
If permitted under the Baw Baw Planning Scheme, a planning permit may be required for the use and development of a shipping container.
Residents should contact the Statutory Planning Department to confirm whether a planning permit is required. Planning approval may be necessary for associated works, including site cuts, modifications to the container, and vegetation removal.
To assess planning permit requirements, Council requires the property address and the proposed location of the shipping container on the site.

A building permit is required if an applicant seeks to use the container as a permanent structure, or if the container is modified and used as a component in the construction of a building resulting in it being classified according to its ongoing use pursuant to the National Construction Code.
A building permit can be obtained from a private building surveyor.
If a building permit is obtained for the installation and use of the shipping container, a local law permit is not required.
