Council's contribution to adjoining properties

The Fences Act 1968 Sec 4 (1) (b) states:

"The occupiers of the adjoining lands shall be liable to join in or contribute in such proportions as are agreed upon or, in the absence of agreement, are determined by the Magistrates Court under this Act. It is our view that no occupier status exists in respect of road reserves (and other reserves statutorily vested in Councils). In these circumstances, Council has no obligation to fence."

 

In accordance with the Fences Act 1968, Council is required to contribute to a shared fencing cost when the Council occupies land adjoining private land, such as kindergartens, childcare centres and other Council owned and occupied buildings.
