Asset Protection Permit

Council requires the person in charge of building works or a building site to obtain an Asset Protection Permit (APP) prior to commencement of building works which have the potential to damage our assets (minor building works excluded).

This is to ensure that our assets are adequately maintained and for the safety of the public during building works.

All building works require an Asset Protection Permit

An APP must be obtained and bond lodged prior to the commencement of any building works which may impact on Council assets. Assets include footpath, kerb & channel, nature strips and stormwater pits etc. The permit can be applied for at our Customer Service Centres or the application form can be downloaded from the attached link.

 

As from 1 March 2012, all works within the Shire will now require an APP with or without payment under Section 3.7 of Local Law 2008. 

 

An exemption from APP payment can be applied for if works:

  • do not impact on Council's assets; or
  • are valued less than $12,000; or 
  • are zoned Rural or Farmland. 

If works exceed $12,000 and you are in one of the above categories, prior to works commencing you can apply for an APP payment exemption, which must be made in writing to our Asset Preservation Officer.

If your claim for APP payment exemption is successful, an “APP – no payment form” will be sent to you - payment and a bond will not be required. 

The APP "no payment form" is to be filled in by the person(s) responsible for the works and returned to Council for processing. The form can be downloaded from the attached link.

The APP may be subject to conditions including:

  • the payment of a security deposit 
  • repair, replacement or reinstatement of our assets.

Upon completion of the building works and Council receiving notification of its completion, the security bond will be refunded to the person who lodged it unless damage has occurred. Click on the link for bond refund form.

If damage has been caused to our assets the bond may be retained to offset the cost of repairing the damage (the damage may be repaired by the contractor/builder or may be reinstated by Council and invoiced to the contractor/builder.
